Maxwell Blum is a partner in Burke’s Oakland office. Maxwell’s practice is multifaceted. In his advisory practice, he advises public agencies on a number of topics, including bidding, procurement, and compliance issues, for example, Public Records Act compliance. He serves as assistant general counsel to a special district in Northern California, attends their board meetings, and regularly assists several city attorneys at Burke by advising their clients.
In his transactional practice, Max prepares agreements for complex public works projects and to help public agencies meet procurement needs.
Max also maintains an active litigation practice. He has worked on litigation cases involving environmental contamination, inverse condemnation, breach of contract, code enforcement, relocation assistance, public nuisance, and other issues.
While Maxwell’s clients are primarily public agencies, he also represents some private individuals and entities.
Representative Matters at Burke:
- Stancil v. Superior Court (Redwood City), (2021) 11 Cal.5th 381 — Prepared successful brief submitted to California Supreme Court arguing that motions to quash service of summons and complaint may not challenge merits of unlawful detainer complaints.
- Friends of Riverside Airport v. City of Riverside: In federal court action concerning CERCLA and breach of contract issues, prepared successful summary judgment motion, assisted with expert report preparation, took depositions, propounded, and responded to written discovery.
- Procurement: Advised Town on bidding and contract issues relating to construction of new Aquatics Center. Advised special district on negotiations of a contract to implement a new water metering system throughout the district, including acquisition of large quantities of meters, and construction of related infrastructure.
- California Public Records Act: Advise public clients on compliance with obligations under PRA.
- Relocation Assistance Act: Advise housing authority on compliance with relocation assistance law during substantial renovations to mobile home park, assist on transactions involved in renovations such as preparing purchase and sale agreements and escrow instructions.
- Other Matters: Appear in court to argue motions; take and defend depositions, assist with preparing pre-trial disclosures, prepare client advise memos, negotiate settlement agreements, and stipulations, assist with code enforcement matters.
