Court Holds Pension Plan Arbitration Clause Enforceable

In Dorman v. Charles Schwab Corp., 934 F.3d 1107 (9th Cir. 2019), the Ninth Circuit held that a Plan’s arbitration provision must be enforced to resolve plaintiff’s ERISA claims for pension benefits under 29 U.S.C. §1132(a)(2) and breach of fiduciary duty under §1132(a)(3).
