Public Law Update – Permitting Curbside Electric Vehicle Charging Stations (AB 2427)

Assembly Bill 2427 (“AB 2427”) mandates that local agencies defined to include a city, charter city, county, and city and county, develop a checklist that includes all of the information required for a complete application for a permit or other authorization to install an electric vehicle charging station within the public right-of-way.  In addition to any applicable fees and charges as part of the permitting or authorization process, local agencies must identify any criteria adopted by the governing body of the local agency to determine appropriate locations within the public right-of-way for installation of an electric vehicle charging station.  As part of this process, local agencies must consider the Electric Vehicle Charging Station Permitting Guidebook from the Governor’s Office of Business and Economic Development to support their implementation of AB 2427. All local agencies must ensure their review and approval processes for electric vehicle charging station applications are limited to health and safety requirements of local, state, and federal law.

If a local agency has a website, it must post the checklist, locations within the public right-of-way and other relevant information on the website.  Likewise, if a local agency determines that there are no appropriate locations within the public right-of-way for installation of an electric vehicle charging station that information should be posted on the website.

Local agencies with a population of 250,000 or more residents must comply with AB 2427 by January 1, 2027.  Agencies with fewer than 250,000 must comply with AB 2427 by January 1, 2029.
